PACKAGE SERVICES
Prima Vista agrees to provide a Package event service arrangement for the Event described above. Services included in this Agreement are summarized below and are subject to the terms and conditions of this Agreement.

PACKAGE INCLUSIONS

VENDOR DISCLOSURE AND ASSIGNMENT
Prima Vista may provide services through its own staff, affiliated vendors, subcontractors, or third-party service providers selected by Prima Vista in its reasonable discretion, subject to availability and operational needs.
Client understands and agrees that Prima Vista will disclose the name of Prima Vista’s Caterer and the DJ assigned to the Event only after
Client has signed this Agreement and
Prima Vista has received the required non-refundable deposit equal to fifty percent (50%) of the total agreement price in cleared funds.
Any pre-agreement discussions, example vendor names, sample lists, or marketing materials are illustrative only and do not guarantee that any particular caterer or DJ will be assigned unless and until confirmed by Prima Vista in writing after the Agreement is signed and the deposit is received.
Prima Vista reserves the right to substitute the assigned caterer, DJ, cake vendor, or other service providers with vendors of reasonably comparable service category and quality if reasonably necessary because of availability, scheduling conflicts, illness, force majeure, licensing issues, insurance issues, performance concerns, or other reasonable business needs. Such substitution shall not constitute a breach of this Agreement.
MENU SELECTIONS
Prima Vista’s offered menu for this package is summarized in the Package Inclusions section above, including the Food & Beverage - Package Menu field for Client’s written menu selections. Once this Agreement is in place, Prima Vista will connect Client with Prima Vista’s Caterer for planning Client’s tasting and finalizing menu selections. Client may also work with Prima Vista’s Caterer regarding substitutions permitted under the package price. If menu items with additional charge are selected by Client, the amount will be added to the balance due.
BAR SERVICE
Bar service is included in the package and will be provided by TABC‑certified bartenders. Bar service includes one bar setup, bar tables and table linens, ice, ice chests, clear cups for beer, wine, and specialty cocktails, bar equipment, cocktail napkins, and stirrers. Alcohol must be supplied by Client unless otherwise agreed in writing. Bar service is limited to a maximum of five (5) hours, and multiple bar setups or experience upgrades may incur an additional fee. All bars will close thirty (30) minutes before guest departure. Prima Vista’s Caterer will require identification from anyone appearing to be under the age of 21 and will not serve alcohol to any person under the age of 21, regardless of whether accompanied by a parent, legal guardian, or spouse, except as otherwise permitted by law. No shots or double pours will be served, and all alcohol must be served with a mixer. Prima Vista’s Caterer reserves the right to discontinue service to any guest in accordance with Texas law and event safety requirements.
ADDITIONAL INCLUDED SERVICE DETAILS
Cake and Cake-Cutting Service. Cake and cake‑cutting service are included in the package. The cake itself will be provided by a third‑party cake vendor engaged by Prima Vista or otherwise designated for the Event. Cake service, including cutting, plating, and distribution, will be provided by Prima Vista’s Caterer using disposable plates, utensils, and napkins as part of the package at no additional charge. Cake tasting is available through the cake vendor and may incur a nominal charge, which will be disclosed in advance. For complex cake designs or cakes requiring specialized dietary accommodations (such as gluten‑free, vegan, or multiple allergy‑friendly tiers), the cake vendor may charge an additional fee, which will be quoted directly by the vendor before any such design is confirmed.
DJ Service. DJ service is included in the package. Prima Vista will disclose the name of the assigned DJ only after Client has signed the Agreement and Prima Vista has received the required 50% non-refundable deposit in cleared funds.
Table Linens. The package includes ivory table linens for guest tables and head table and black table linens for the cake table, buffet table, and related service tables.
PAYMENT TERMS
In order to secure the Event date, Prima Vista must receive a signed Agreement and the non-refundable deposit listed above. The deposit shall be applied toward the total agreement price. The remaining balance is due no later than thirty (30) business days before the Event. Failure to pay the remaining balance by the due date may result in cancellation of some or all contracted services.
GUEST COUNT AND FINAL PAYMENT
Client must provide a final guaranteed guest count no later than thirty (30) business days before the Event. Client will be billed for the final guaranteed guest count. If actual attendance exceeds the guaranteed number, Client will be billed for the additional guests following the Event at the applicable package rate.
MENU CONFIRMATION
Final menu selections must be confirmed no later than thirty (30) business days before the Event. No menu changes may be made after that deadline unless Prima Vista agrees in writing, and any approved late changes may be subject to additional fees or service limitations.
MENU SELECTION, DIETARY RESTRICTIONS, AND ALLERGIES
Client is solely responsible for selecting all menu options and for disclosing any dietary restrictions, food allergies, or special meal requirements for Client and Client’s guests to Prima Vista’s Caterer. All such disclosures must be made no later than the final guaranteed guest count deadline, which is thirty (30) business days before the Event. Prima Vista’s Caterer will make reasonable efforts to accommodate timely disclosed dietary restrictions; however, Client acknowledges that Prima Vista’s Caterer cannot guarantee an allergen-free environment and that food may be prepared in facilities and kitchens that handle common allergens, making cross-contamination possible.
By entering into this Agreement, Client acknowledges and agrees that (a) all known dietary restrictions and food allergies have been disclosed to Prima Vista’s Caterer by the required deadline; (b) Prima Vista, Prima Vista’s Caterer, and their respective owners, employees, contractors, and agents shall not be responsible or liable for allergic reactions, illness, or dietary issues arising from undisclosed allergies or dietary restrictions, or from unavoidable cross-contamination; and (c) guests with severe food allergies consume catered food at their own risk.
CANCELLATION POLICY
Client may cancel the Event more than thirty (30) business days before the Event date. The deposit is non-refundable. Any payments made after the deposit will be refunded only if cancellation occurs more than thirty (30) business days before the Event. Any payments made within thirty (30) business days or less of the Event will not be refunded.
INSURANCE AND LIABILITY
Prima Vista and/or its vendors may carry commercial general liability and liquor liability insurance for the Event. Client shall defend, indemnify, and hold harmless Prima Vista and its owners, employees, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with Client’s use of the venue or the acts or omissions of Client, Client’s guests, or Client’s vendors, except to the extent caused by Prima Vista’s gross negligence or willful misconduct.
GENERAL TERMS
This Agreement constitutes the complete agreement between the parties concerning the Package services for the Event and supersedes any prior discussions or informal understandings concerning the same subject matter. No modification of this Agreement shall be binding unless made in writing and signed by both parties. For clarity, “Prima Vista” refers to Sky Vista Retreat LLC, the owner and operator of the event venue Prima Vista, acting in that capacity.
By signing this document, you hereby acknowledge that you understand the policies above and agree to abide by all the provisions held within.
